EEA Spouse Questions US to UK

Post by helena11 » Thu Jul 06, 2017 5:24 pm

Hello everyone,

Me and my fiance are planning on marrying here in the US and then move to the UK from here. He is currently living in the UK and is a qualified" person, he is a Polish national exercising treaty rights and I am a US Citizen.

After receiving the marriage certificate, would we be able to apply straight away for the EEA family permit to gain clearance to enter the UK? Also, I've read that it is not necessary to have the EEA family permit to enter the UK as a spouse of a EEA national though you can be refused entry; is this true? Also, how long would the process of applying for the EEA family permit take? Considering we want to leave a couple of days after marriage? I am confused of the process.

Any information on this is much appreciated :D

You won't have the Family Permit within 2 days as you are unable to submit the application until you are married and have the marriage certificate!

If travelling without an EEA FP, as a non-visa national you are able to enter the UK as a visitor, but you should be truthful with the Immigration Officer at UK Border control that you intend to reside with your EEA national husband.

Having an EEA Family Permit would make the whole process simpler.
