Dear Moderators and Experts
My Grandmother had visited me on a normal visit VISA and unfortunately she was diagnosed with a life-threatening condition during her stay.
We had to extend her stay beyond the permitted 6 months and applied for this to the Home Office.
The home office kindly extended her stay for another 6 months (via a BRP) on medical grounds and we were able to treat her privately.
she is due to go back soon but I have been informed by a friend that because she overstayed (albeit with permission from UKBA) she will not be able to apply for a subsequent VISA to come back until 6 months have elapsed after she has left the UK.
We have a follow-up appointment by the consultant in 4 months and I feel restricting her to apply for a subsequent VISA will not allow her to attend this follow up appointment and this in effect is not fair and limits her access to medical care.
Could you confirm if this is true as I can not find this clause stated in any official letters from the UKBA.
Looking forward to a reply.
Many Thanks
