Hi All,
Just need to ask someone if they know anything?
My husband came over as a Tier 4 student. He was granted a extension on his visa back in 2013. Then on 2014 it was cancelled due to this Toiec exams. We then got married.
He applied to HO back in August 2016 but never received a decision. Only a biometric letter. Which he did. Due to his father becoming very critically ill we decided that he had to go to India to be by his dads side. So he decided to go to India voluntarily but only received his passport back, no other documents.
Since he has been gone he has done the English test, tb test, renewed his passport.
I am disabled he is my full time carer.
Can any body tell me what I can do to get him back into this country, as he is my full time carer. What documents I have to submit and how long will it take? Thank you for taking time to read this.

He will have to submit a new application for a Spouse Settlement visa (2.5 + 2-5 years).

As the sponsor you are required to submit evidence that you meet the adequate maintenance level. See this thread on the forum:

In addition to the visa fee of £1,464 he will also have to pay the £600 NHS surcharge.

Hi,

As I am disabled will I need to still show £18,600 for my husband to come here.

He is already on my tenancy agreement. Showing he can stay here with me.

No. You need to show 'adequate maintenance' which is why I posted the link with the information regarding how to calculate this. :idea:

Any other documents I need to show the Home Office.
Tenancy Agreement. (Both names)
Adequate maintenance
Electric bills ( both names)
Gas bill ( both names)
Correspondence between us since he went back.
Telephone ( calls)
All other documents are with the home office so I have only copies of marriage certificate etc,
Should this be fine.
Or shall I get some more documents.

But what about the documents (original) that are with the home office?
Let me know.
Or will they accept the copies ?
Will he have to go for an interview?
How long is this process?

You can submit copies with the explanation that the original documents are already with the HO.

I can't say whether you will be interviewed or not or how long the application will take to decide.

It doesn't apply to your case since you are applying through adequate maintenance and not Minimum income requirement.

He can apply as soon as you are confident that you have everything you are required to submit with the application.

UPDATE TIMELINE
Spouse settlement visa.
APPLICATION SUBMITTED ON 04/08/2017
Standard application.
RECEIVED A TEXT FROM VFS SAME DAY PAPERS ARE NOW WITH THE SHEFFIELD OFFICE.
Received a text on 07/08/2017 from Sheffield.
RECEIVED AN EMAIL FROM SHEFFIELD ON 04/09/2017 SAYING APPLICATION IS NOW WITH THE ECO ALL PAPERS TO BE SUBMITTED IF NOT DONE SO.
Received an email on 19/10/2017 a decision has been made but it was from VFS GLOBAL.
RECEIVED A TEXT SAYING PASSPORT SHOULD BE DELIVERED ON FRIDAY 20/10/2017
Received an email saying the pin code was wrong so it should be with you on the 21/10/2017.
PRAY FOR US
Let see what happens. Been checking to see if the IHS has been refunded but nothing yet.
Fingers crossed.
