How to get the MP involved

Post by legalkhan » Tue Jun 20, 2017 2:06 pm

Dear Forum members and moderators,
I had varied my Entrepreneur ext application in last week of November2106, so far waiting on the decesion which look like will never ever come through. All the other applicants I know with the same circumstances like me have got their decesion long ago. I am really getting out of patience and planning to get my Local MP involved in it. Should I email him? Write a postal letter or can be visited to meet her directly? Which way people normally communicate with them. Please based on information/ Experience advice me how to go for it.

I would specially request the moderators and senior helping members to throw some light it, would be highly apprecited.

No personal experience, but I study political procedure and MPs communications was a part of my studies earlier.

There is no standard way to contact your MP. Each MP's office works in its own way, based on their personality and also on their constituents' and their constituency. Thus, MPs' comms would differ based on whether they are in a student-heavy town (more Whatapp and Facebook) or in a retiree-heavy locale (more paper and face-to-face based). The comms of the MP of the huge (more that 13,000 sq km) and hilly Caithness constituency would differ from the comms of an Inner-London MP, for example.

Your best bet is to call the MP's office and ask. They will normally tell you how they would like the details of your case. Some prefer it in paper, so that it can be filed, especially if it is a complex case that already has a lot of paperwork. Some prefer emails. Typically, MPs' staffers would first go through the case and either write a letter or email for the MP to sign off. They may contact you for further information if required. Only if a case is intractable would it actually land on the MP's desk.

As an aside, be nice and polite to the MP's staff. The senior MPs' staff work 12-16 hours a day for a salary ranging from about the median salary (about £24,000) to nothing (they are volunteers, in it for the experience). And in the bargain, they get abused by everybody from their constituents to people from other parties to random strangers. I cannot comprehend why anybody would want to do that job.

Two things to remember
a) An MP is not obliged to take your case or your side. S/he is doing it for your vote (to cultivate a personal vote) and for his/her reputation as a constituency MP. There is no legal obligation on him to do anything.
b) If you have dealt with your constituency MP in the past and s/he has changed, be aware that due to data protection rules, MPs can't pass on your data and queries to their successor. So, you would have to start from scratch with the new MP and their staff.

I went directly to my MP's local surgery and explained him the issue and provided a copy of home office letter. He wrote to home office and sent me a copy as well via post.

Hi legalkhan,
Did UKVI give you a time frame of the decision following the letter of complex? if yes I will say you may probably wait till the fate as they (UKVI ) may repeat the same to the MP.

Thank so much secret.simon, vegeta and eoo10 for such a prompt and helpful response.

@eoo10,
My case is not of complex nature, no such letter received from H.O. The only letter I received from home office was in the last week of 6 months wait stating that due to high volume of application they cannot process my application within the 6 month time period. At the end of 7 month I send them a letter due to which they came back to my case and sent another letter to me asking for all the relevent documents of Entrepreneur visa for the last 3 years. I had already submitted those docs at the time of Entrepreneur Ext application. 4 of friends had never asked about these docs and H.O gave then decesion with in 3 to 4 months. My circumstances being the same but due to some reason my case worker is streching the process longer regardless of caring about the frustration we might be in. I have some personal problem back in my country that needed to be sorted out, but how can I go without our passports.

If you are still within the date that you have been given to submit the additional document regardless of when you responded to it, I will advise that you give UKVI couple of weeks after the date hopefully you will get a decision. I

I have sent them a letter explaining that all the documents relating to my previous visa has already been submitted with Entrepreneur Ext visa but again I don't know if they decide to retrieve those docs from the other dept then again it will take a lot of time as we know how slow HO is with this.

One of my friends contacted local MP.
You may email + post your letter to MP and he/she will respond. Make sure to mention all the necessary details. ie; case number, Full Name as per the PP etc. HO should respond to MP (I have heard that there is a dedicated section in HO to deal with MP's letters). However, there is no guarantee that HO will speed up the process or approve the application just because of the MP's letter. My friend is still waiting for ILR and has passed 11 months to date.

Tier 2 General. Friend believes the reason for delay + HO visit to company is something to do with the salary increment within last year (before apply for ILR the salary was below the eligible limit). Salary increment was a genuine one as per the friend though.

Responded to H.O but still waiting

Post by legalkhan » Mon Jul 10, 2017 5:50 pm

Dear Forum members, Gurus and moderators,
It's almost a month since I responded to the letter from case worker/H.O who wanted some documents from me but still no decision. In the letter they said that as soon as they get the letter, my application would be decided promptly. The 9th month has already been started and don't know what they mean by prompt decision. Its getting very frustrating. now. Any idea what I should beside waiting.

Could you please advice me whatelse could I do. I have to visit my parents and see my mother, she has not been well. I am in very tense situation. Please help me out.
