Self employed, Vary FLR (FP) to FLR (m)

As a dependent of Tier 4 (G) student, my current visa is valid until 10th July 2018. My husband got his indefinite leave to remain (ILR) on 13 September 2016. On 13th January 2017 I submitted my application FLR (FP) to switch visa category to dependent of British settled person (spouse). The normal standard service time is 8 to 10 weeks, and now, it is more than 25 weeks and I am still waiting for decision.

Currently my husband is working as mini cab driver (self employed) since December 2016 and earning around £25,000 per year. Would it be possible that I can vary my application FLR FP to FLR (m). As he is working since only 8 months as self employed and he did not paid any tax, every week he get his money in his bank account from the cab office. In this situation he can show his bank statement as well as weekly statements issued by the cab office. Before ILR he was student.

Please guide that does he need to pay tax before applying to vary FLR (FP) to FLR (m).
