Working on Family Reunion visa for Germany for Non EU Spouse

Hi all,

My spouse (Belgian Citizen) and I (US Citizen) are both living in the UK. My spouse has been offered a job in Germany. With freedom of movement, I understand that I will be able to accompany her (move together) and have freedom to work in Germany as well.

We have been basing most of our understanding on this document:

Is it correct that:
1. We can simply gather the documents listed on this form and bring them to an appointment for our application?
2. Processing time is under 2 weeks?
3. I do not have to prove German language ability, as we are moving to a different country than my Spouse's home country?

I would appreciate answers to any of the questions. I've been having some trouble contacting the German Mission in London by phone and email, and just want to make sure we aren't way off the mark.

I assume you have a Residence card named "Family member of an EU national" from UK and also you are US citizen in both cases you are visa exempted to enter Germany. As a belgian who plans to work in germany and you as a spouse moving along with her you fall under directive 2004/38. therefore you do not deal with the embassy at all in the uk . but the county/state in Germany. For Berlin, this should be your reference https://service.berlin.de/dienstleistung/324282/en/ and those are the documents you need along with an appointment. The maximum time allowed for you to get the residence permit is 6 months but usually should be done in a month or 2. You are allowed to work even while waiting for the permit.

I am actually on my own Tier 2 work visa in the UK. We were married after I moved here on the work visa.

That is just fine. You get to enter germany as being an american. The rest of the process is exactly the same as in the link for berlin.
