Hi,

My business partner is not applying for extension visa and he intends to leave UK couple of days before his expiry of visa. My question in HO point of view

1. Can I show him as sleeping partner, having no involvement in business activity but yet retain his investment for dividend or do he need to withdraw his investment and I need to inject my own remaining £25K to complete £50K

2. Is it necessary to show bank letter with name, signatory and last balance in bus account to HOt? as I haven't seen that requirement in HO guideline?

You can claim points for investment made by you and your partner.

You need to send an original bank statement OR the bank letter.

Hi,

Just have two question. My business partner didn't apply with me for extension. I applied as a single and not as a team. I made all 50K investment in my business and my business accounts reflecting that. Recently I have transferred all my business partner shares to myself and now I am the sole owner of business. My question is do I need to let inform HO about transfer of shares to my name and being as sole owner of business now. It has been updated on company house websites anyway.

second question I have several clients whom I not only provide management accounts service but also doing a Quantity surveyor ( Mainly looking construction cost and contracts ) for them. One of my client literally has over 70 million turnover. Recently during friendly conversation at pub, I put up my frustration and issues about delay in entrepreneur visa and the hostile attitude of HO. The directors offers me TIER 2 SPONSORSHIP at there. My question is can I variant my application from T1 ENT to T2 Sponsorship before coming any decision or do i have to wait for the answer of my first application? Reason to turn into T2 is very simple. quick decision as premium service is available and no cumbersome documentation.

Yes, you can vary before a decision is made. In fact, you can ONLY vary an application before decision is made. After it is decided, you need to do a fresh application.

Hi

I have quick question to the moderators especially star Marcnath.

My business partner left the country 2 days before I was applying for extension in Aug 17. He also withdrew his investment. But I deposit same amount back in business account at same time when he was withdrawing his share so that if case worker see in future he could understand easily. However, I haven't got the chance to take him out from the business and bank and submitted my application to the Home Office.
After I submit my documents (as single and not as team) to Home Office, I become 100 % owner of my business and director. Also I took him out from the bank joint business account.
It has been now 10 months that my application is with Home Office. My question is do I need to tell Home Office about later development in my business or shall I leave it like that as they can check the status through company house and call bank about the status of account holder.

There is no requirement to update the HO of business changes.

If you are interviewed, you can update them on the changes at that time.

I have received letter from Home Office asking about my team member who left the country.

Can someone please correct following draft which I have prepared for my answer to Home Office.


Dear xxxxxx,

I am writing in response of your letter dated 18/06/2018 in which I have been enquired about my former business partner xxxxxxxxxx
.
Mr xxxxxxx has left the country without applying for extension of his business visa. He departed from the country due to his personal reason on 23/08/2017 just two days before of visa expiry. Since he was with me all three years in busiuness that is why bank statement and accountant letters have mentioned his name. Following his departure, I got the total control of my business in terms of shares and bank account. So now I am the sole director of the business and bank account holder. This can also be verified through company house website.

Moreover, I have applied the application as a single applicant (as per my application page 41). The company three years accounts and agreement reflect the investment on my name.
