my child's dependent visa refused

my child's dependent visa refused

Please, Gurus, I need direction,
My child was refused entry clearance because no birth certificate was included.
The child has on 4 different occasions in the past been granted visa as my dependent. This is the first time he is applying out of the country except for the initial visa. We have since dispensed with including birth certificates in our application package.

I intend to go for an AR. Please is there any Law, Rule, or Case on "taking notice" of facts already established??

What VIsa are you on ? How did you end up applying from out of the country after 4 prior extensions.

Initial applications generally need all documentation. In extensions, you can depend on previously established criteria.

That is normally clear in the application/guidance document, which makes challenging it in AR difficult.

But other more experienced people can say if there are precedents that allow it.

I'm on T1 entrepreneur.
Child went out of country for a period, and ready to come back now.

I have applied for my dependents(children) for leave to remain in country and i think it says in forms no need to provide birth certificates if dependent visa granted before.I am not sure if same is the case with new entry clearance

Update on my child's application.

We requested an administrative review stating that my child is deemed to be known to UKVI since that is the basis of the biometrics system.

The decision was reversed by the entry clearance manager.
We resubmitted my child's passport and collected it yesterday,11 days after the resubmission.

Congratulations - glad it worked out. That was a good argument to use.
