Zambrano derivative rights or leave to remain as a parent

Post by Momden » Thu Jul 20, 2017 12:48 am

Hi people,
I need advise on what route is better to extend my visa?
Zambrano derivative rights or the leave to remain as a parent 10yr route. Aside from the massive difference in fees between the two, it appears that with derivative rights, one can access benefits/public funds but with LTR you can't, is that correct?
It's a long story summarised I'm a single parent to a 4yr old and though I work fulltime, not having access to tax credits and even child benefits seems so unfair to my child and me. I'm presently on flr 10yr parental route, can I switch to derivative right of residence on basis of parent of British child?
Is there any regulation that says you can't switch from EU to UK?
Also, does time spent under derivative rights count towards long residence?
Hope to hear your responses. Thank you
