Im not sure if I'm posting in the right forum or not but I will try my luck.
I'm very hopeless and can barely eat or sleep or live my daily life in a normal pace .
Basically, I have a court hearing date on December 2017 and my situation is the following:
I applied for a spouse visa within uk on January 2016 I wanted to switch from student one to the spouse visa. I got rejected as we had insufficient funds. Then we went to the lawyer so she can take all the work and do it for us. My visa was expired by then as it expires on the 30th of January and we received the decision of the home office on February. We sent another application to the home office but this time it was sent back because of non payement of the health surcharge. The lawyer said to us we don't have to pay it as it was paid in the initial application!!!! Now that it got refused. She told me that you can be considered as an overstayer but becasue you applied before your visa had expired you won't also she said I will send an extension request to the home office so that you won't have that status but I believe she didn't sent any request for an extension and she advicd me to sent for the third time a new application! I did what she advised us to do! No luck as the home office turned back our application knowing that everything detail was covered from my husband's income to the place where we live in to pictures of our marriage ect we provided everything unfortunately I didn't get the visa but the gave us the right to appeal. Now I have a court hearing date ok the 20th of December 2017.
Please, do I have any chance to get my visa? Do I have any chance that the judge will be by my side?? Does the home office have any chance them ri appeal if the judge is on my side
