Evidence of sponsors UK residential status for spouse Visa

Post by ned0008 » Sat Jul 22, 2017 2:57 pm

Dear knowledgeable people,
I'd really appreciate any information regarding what evidence of the sponsor's [myself] UK residential status would be necessary for the purpose of a spouse/fiancé visa. I have found some relevant information on this site, but would really like some confirmation in regard to this.

Quote ""evidence of the sponsors UK immigration status - certified copy of passport - the bio data page, WP/HSMP approval letter and accompanying visa, ink stamp or residence permit sticky vignette should do""

I've lived in the UK since 1978 when I arrived from Australia with a British father and Australian mother with right of abode in the UK [through her grandparents]. I think I first had a certificate of 'patriality' in my mother's passport at the time of arrival. At some point this was changed to an ILR stamp in my own passport.

Of course if I had a Biometric residence permit that would be ideal evidence. BUT, I was out of the UK for longer than two years quite recently (I had no idea there was a 'two year rule' for ILR holders!!) luckily on return the immigration officer stamped me in as usual after checking my old ILR stamp in my expired passport [she didn't ask how long I'd been absent from the UK...

To summarise my question, is this old ILR stamp sufficient evidence of my residential status for the purpose of the fiancé visa? or would I definitely need a BRP??

Many thanks
