Asylum seeker query

Post by NB822 » Sun Jul 23, 2017 11:28 am

Hello,

I have a query which I'd really like some advice on.

I have a partner who I've genuinely been involves with for the last 6 months. We would like to get married and because I come from an Asian family, both parties have to be formally introduced and need to approve of each other.
I've been born and brought up in London, however my partner came to the UK from Bangladesh 4 years ago as a student. He finished his degree and in the last month (Oct 2016) of his visa running out, he applied for asylum as there was political problems in Bangladesh which he was afraid to go back to.

He has been screened and interviewed. Home office took away his passport and gave him an Application of Registration Card (ARC). He was told to provide more evidence and was taken to court (May 2017) whereby he was told they would let him know within a month. They still haven't let him know, I'm aware that means it could take up to 6 months or more and there is a chance he may be refused. His case has appeal rights because of the way it has been applied.

My family are finding it difficult to understand his case and believe he is an illegal immigrant therefore they are being reluctant to accept his hand in marriage.
Similarly, they fear if we do get married, he will be deported back home where I'll have to do a spouse visa and bring him back. They do not really want me to be involved in something like that because of the complications and emotional difficulties it brings not forgetting the time period before they agree to legalise him.

I wanted to get our religious ceremony done to prevent complications, and wait until Home Office give him an answer before doing the Court Marriage however my partner thinks doing the Court Marriage will help his case.

My query therefore is the following;

1. Is he an illegal immigrant?
2. Will marrying him, help his case as it's currently pending case or will marrying him cause them to refuse? Needing me to apply for a spouse visa?
3. Would it be possible to do a court marriage? Because he doesn't have his passport? What proof could he take?
4. Will they take me into questioning when we apply for court marriage? Our relationship is genuine.
5. How long do you think it might roughly take before he gets an answer?

I would really appreciate an answer and some advice.

Thank you.

1. No, as he is under protection while his asylum application is being assessed and decided.
2. Your marriage will make no difference to his application for asylum.
3. He would have to request a copy of his passport from the HO.
4. If you want to marry legally in the UK you will have to register your intent with a Home Office designated Registry Office. The Registrar is legally bound to notify the HO who can then extend the registration period from 28 to 70 days in order to interview you both separately should they choose to do so, before the marriage can go ahead.
5. No one can predict how long it will take for a decision to be made.

Thank you for replying Casa.

I also wanted to ask, do you think there's a chance that he will be deported back home whereby I would have to bring him back here?

And secondly, what kind of questioning would we go through separately if we go for a Court Marriage?

Thank you again.

I can't give you any assurances whether he will or not.

And secondly, what kind of questioning would we go through separately if we go for a Court Marriage? General questions that a genuine couple would be expected to know about each other...and whether the answers match what each of you have given separately.

Thank you again.
