Case worker put ILR on hold due to no HMRC returns

Post by happysunny » Mon Jul 24, 2017 4:27 pm

Hi can any one please look to my case:

My current requirements are all fine, It' s about my previous extension.

I applied for Tier 1 extension in 2013. I claimed my points through wages and dividends (Tax Year 2012/13 and 2013/14) My case and then appeal was refused so I closed my company as I was ready to go back. Then upper tribunal decided the case in my favor. (Long story short, home office lost my document and judge caught them)

2012/13: Company Tax Returns filed and declared income in SA302
2013/14: Company Tax returned could not be filed by the end of the year because the company was closed but SA302 income was declared with dividend income.

Now the company could not be re-opened because of companies house rules. (even court order will not help because company was not opening for trading or recover assets). My accountant has suggested that give the dividend tax of that year to next SA302 by mentioning all above in notes. That has been done

MY SA302 is perfectly fine but can the case worker could still ask for company tax returns (CT600) for previous years. If Yes then will the above solution will work?
