EEA Family Permit for Mother of minor EEA national Child

Hello,

i have searched a lot about my question, but actually don't found anything like this..
Our Family wants to go to the UK (by ferry) for 1 Week for visit.

First question: I have heard and read, that it is possible to became a EEA Family Permit at the border for a Non EEA National, who is entering the UK for a visit with his spouse, who is a EEA National. Is this right ? They are coming to the UK from an EEA State.

The second question is the main question of this topic, because i don't find anything about it on the internet: It is also possible, that a Mother (who is not an EEA National, but lives in Germany with his child and have a residence permit) of an EEA National minor Child (15 years old) became a EEA Family Permit at the border (because of her child) ?
They want to visit the UK together for 1 Week and also comes from an EEA State

I hope that anyone can help me, because it is a short term trip to the UK..

The answer to the first question is that it is quite possible, though there might be a problem if the marriage certificate is from outside the EEA and the Immigration Officer can't read it. However, the best document to use is a German residence card issued under theGerman EEA regulations (Article 10 of the directive) stating that the mother is the family member of an EU citizen. According to the online publications of UKVI, a permanent residence card issued under the EEA regulations (Article 20 of the directive) is also acceptable, just as in the Schengen area. With the card, there is absolutely no reason to apply for a family permit.

The second question is more difficult. I may have misread the regulations, but it seems to me that there are two problems:
(1) If the child is not British, then the child needs to be 'self-sufficient' if it were resident in the UK, which requires 'Comprehensive Sickness Insurance'. A European Health Insurance Card might suffice.
(2) I assume mother and father both have responsibility for the child, and that the father is an EEA citizen not banned from the UK. In that case, the two parents would have to come together, which brings us back to the situation of Question 1.

So, I think the practical answer to the second question is 'no'.

I forgot to mention that without a family permit or residence card, it can be difficult to reach the British border. One can't fly to it. On the other hand, the 'juxtaposed border controls' are accessible in France and Belgium, and one can successfully assert one's right to enter without family permit or residence card at those borders.

Yes, this is what i will try with my wife at the UK Border in France.

My mother and minor sister will not try it with the Regulation Number 15A at the Border in France, because, as you say, it could be very difficult for them at the border.

Next time we will apply for the eea family permit before we start a trip to the UK.
