Problem Convincing employer that I have the right to work

Post by runie80 » Fri Feb 15, 2008 4:02 pm

hello Everyone

Finally after 2 panel interviews.

I have been offered a position and this is the job which is really really really wanted.

but there is a problem <yes i know>

The problem is that my Employer is not convinced that I can work in UK

I am NON eu spouse of EU citizen

and have EEA FAMILY PERMIT <which is expired>
after we applied for EEA1 & EEA 2

Now My wife has full time job and has Signed for WRS and i will be applying for FMRS.

I have send them these links

http://www.bia.homeoffice.gov.uk/euciti ... sibilites/

and

http://www.ukvisas.gov.uk/servlet/Front ... 8721068382

which clearly mentions my right to work

and i have explained them my right to work here
and that EEA family permit is an entry clerance and not a VISA and
the 6 month validity is just to facilitiate my movement from one country to another.

But it looks they are not convinced yet.

my head is near exploding

any advice on how to "convince" them

regards

My experience of such situations is that its difficult to prove anything unless you can produce evidence to back up your claims. Most HR personnel are poorly trained and are not aware of (and don`t care) about the ins and out of the immigration system...I wouldn`t count on your HR actually checking the links that you sent them. I would suggest printing out the relevant pages and sending it to them after highlighting the bits which refer to your right to work here. If that doesn`t work, maybe you could try and get a letter from an approved immigration solicitor confirming your right to work..

Thanks Thirdwave.

Your suggestion seems fine to me.
