TIER 1 ENTREPRENEUR ILR DEPENDENT STAY REQUIREMENTS

Post by memoa » Tue Jul 25, 2017 4:45 pm

Hi guys,

I need expert explanation and advice, I found smaller case to me but the guy who posted this was in Tire 4

I am on Tier 1 Ent extension visa and I will apply for SET (O) ILR 5 year’s route next year. I am married (my wife has become dependent on my visa just last year after the extension ) so her visa will be ended as me my visa date, and I have a UK born child (16 months) on a Tier1 dependent as well.
Now my confusions are:

1. My Child is the UK born, I heard confusing advice and does my child qualify for British Passport straightaway using the MN1 registration. My child is added to his mum in Passport to be able to travel but he was born in the UK before I got settlement status and he does not have any passports if you could advise which form or route for my child.

2. For my wife, does she need to apply with my application (the same date)? Or some other route, she has been in the UK 3 years as a Tier 4 student and will be less than 2 years as dependent Tire 1 Ent when I am going to apply for my ILR. If she can apply with me in my ILR, does the financial requirements of £22400 salary is essential (as we have a child) or not. Please clarify what route and the requirements.

Thank you very much for your help

Child does not need to have a passport
Register the child as British Citizen using MN1 after you are granted ILR. Costs £900.
2. For my wife, does she need to apply with my application (the same date)? She remains on PBS dependant visa until her 5 years is complete. Then ILR.
No income requirement for PBS dependants to ILR

Hi zimba88,

Thanks for your quick reply.

So as I understood, I don’t need to include my daughter in the application of ILR. But as we all knew that the application for the ILR could take some time and her visa might expire during the time of waiting for the decision. Therefore, will that not be classified as overstayed later on in her MN1 registration?

If there is no income required, is there any saving money (balance) that is needed to be shown during the application for my application and my wife as well? (just to have a peace of mind)

Thanks for your valuable advice.

Overstaying has no effect on her registration. However this could have a side effect if your ILR is refused.

Nothing specific. You simply need to show you can maintain yourself. Send three months payslips or savings
