(i) Evidence of a maintenance agreement through any of the following:
(1) A court order; (2) Written voluntary agreement; or (3) Child Support Agency documentation.
(ii) Personal bank statements for or from the 12-month period prior to the date of application showing the income relied upon was paid into an account in the name of the person or of the person and their partner jointly. The bank statements should cover the period for which the income is relied upon.
this document has caused a huge headache and I can not find a way out of it at all. My questions are:
1. In the bold part (section (d)), it talks about applicant receiving child maintenance payment, where for UK Spouse visa application, only the UK Settled persons income is counted. Leaving that aside, she gets maintenance payment for Children. Will that get accounted for? { Our solicitors told us that child maintenance payment will get counted}.
2. In the last paragraph, it says " Personal bank statements for or from the 12-month period prior to the date of application showing the income relied upon..." which is indeed pretty much confusing and it gets bitter after reading the last sentence "The bank statements should cover the period for which the income is relied upon.". We did a lot of search on the internet and could not find anything helpful. According to this quoted text, am I supposed to submit 12months of Child maintenance payment? (if so, she is receiving it from November 2016 only). Or submitting 6 months Child maintenance will work?
Meanwhile we were going to make payment for the application tonight and we thought to double check everything and found that confusing paragraph and it states the same thing on page 38, paragraph 6.1.1, 4th bullet point in much more easier and straightforward way without including any information about the 12 months payments.
I would be grateful getting an answer from a senior member of this forum or anyone who can help us.
It has taken my sleep away, stayed all night long just to find an answer for this.
