Can I apply for a fiancé visa?

Post by Benny3991 » Mon Jul 31, 2017 12:38 pm

Hi all

6 months ago I was removed from the uk due to the fact I had overstayed my visitor visa, I entered the uk legally on a visitor visa when I was 14 and overstayed till I was removed at the age of 25, I have a British partner and we have been together for four years, my partner iscurrently at university and cannot meet the MIR, can we still apply for a fiancé visa, as my partners parents are willing to be a third party sponsor? I need advise from anyone who has more knowledge about this case, thank you guys...

Overstaying a few days is unlikely to jeopardise any visa applications, but they're not going to disregard 11 years. But if your chances of being granted a visa sound bad from that...

If you were removed, as in you failed to leave voluntarily and the Home Office had to enforce your removal, then there's a mandatory 10 year ban on your re-entry, which practically means any visa application you make will automatically be refused for 10 years from the date of your removal.

If on the other hand you left voluntarily, then when and how you left would depend on whether it was a 2 or 5 year ban. It's all in here, so you can probably find the one which applies in your particular case:

In the circumstances your partner/proposed spouse's income wouldn't be a factor.
