EEA permanent residence from 2008-2013 validity

Post by gothical » Wed Aug 02, 2017 12:10 pm

Hi,

My question is 2 parts:
1st Part:
a. My wife is a Lithuanian national and she has a worker registration scheme certificate that was issued on 10th March 2010 but the document states that her Job start date was 17 September 2008. Does the issue date matter or will her employment be valid from the job start date issued in the certificate?

b. Her payslips varies from £60 a month to £700 a month. Does it matter how much she had worked during that period to count as employment?

c. Her first payslip is 30/09/2008 for "£157.38" and her last payslip was on 05/09/2013 for "£48.16". The payslip before this was on 31/03/2013 for "£46.50". So, as you can see, very little pay but the gap is less than 6 months. There are no other big gaps in her employment.

She went self employed from mid of 2014 so can't use the period after that and she is full time employed again now but we will need to use the 2008-2013 period. Can someone advise us whether the information is enough for us to apply for PR?

2nd Part:
My eea2 visa is ending in December although we married in July 2012, so 5+ years now.
a. Should I try to get PR with her or should I apply for the family member separately for now and apply for PR once she gets hers? I'm trying to avoid having no visa if the PR gets refused due to my new job and the HR decides to make a fuss.

Thank you for your help in advance.
Al

PR loses validity after 2 years spent abroad.
If your wife got PR in 2013 and she hasn't spent more than 2 years since abroad she is still PR and can get PRC certificate. On top of that being self-employed counts towards 5 years living in UK so she can include that period as well (providing it was in UK).

I'm not expert. Only applying for PR soon, so I'm reading everything I can on that matter.

Hi Sawitar,

Thanks for your reply. I'm not sure if she was eligible for PR in 2013 hence the questions.

She hasn't spent more than 2 years since and we have council tax/bank statements/self employed submissions to HMRC etc to prove that. I don't think the self employed period will count as it is greater than 6 months gap since 2013 September to 2014 May when she started self employment.

Hopefully someone else with more knowledge and experience can shed some light on this?

Kind regards,
Alice

Bump. Can anyone just answer if pay is relevant to showing work for 5 years please?
