Are we eligible for a British passport?

Are we eligible for a British passport?

My partner was born in this country and has lived and worked here ever since, 30 years. He is a passport holder of our motherland. His mum also has been granted an indefinite leave to remain years and years ago. Can he simply just fill in a British passport form.

I too have an indefinite leave to remain, although I was born many oceans away. My parents brought me here after eventually deciding this country was the one worth settling in, they too have an indefinite leave to remain but are non UK passport holders although all my siblings are British passport holders. Am I eligible although I wasn't born here but my parents brought me here after there ILR.

My daughter was also born here from both ILR parents. Is she eligible?

We have forever procrastinated in applying passport as its non refundable if its rejected. Any advice is very much appreciated. Do we really need to do the life in the UK test.

Your partner will only be a British CItizen if his mother had indefinite Leave to remain at the time he was born.

If his father had indefinite he will be fine provide he was married to his mum at the time of his birth or any time thereafter.

Yes if:
- he was born before 1983; or
- his mother had ILR when he was born; or
- is father had ILR when he was born and his parents were married.

Otherwise he needs to apply for British citizenship. Options would usually include Form T (if he lived in the U.K. until age 10) or UKF (if he had an unmarried father with ILR).

You need to be naturalised if you want British citizenship/passport. Unless there is something else you've not mentioned (example- ties to a British territory or former territory) that could give rise to a claim that you were British when born.

British born with an ILR parent (if parent had ILR when she was born)- should mean that she is automatically British.

Unfortunately his mother was granted ILR 6 years after his birth. His parents we're not married. Father deceased so unsure if he had ILR.

Will he need naturalisation and to also apply for British citizenship.Does he need to do both or can he just apply for British citizenship. Are this both integrated?

In my understanding I will need naturalisation before applying for a British citizenship.

Applying for naturalisation is the same thing as applying for British citizenship. You will need to be naturalised before applying for a British passport (is that what you meant?).

Done my research before posting that question.But yes, they are one of the same. weighing the advantages and disadvantages right now.

He could have been registered as a British citizen based on his mother's ILR until he was age 18- too late for that now.
Regarding his father, if you could get details of whether the father had ILR (or British citizenship) there might be an option to apply for British citizenship on this basis (UKF).

Otherwise, in order to become a British citizen he would need to apply either for naturalisation or- if he lived in the U.K. until age 10- registration as a British citizen using form T.
