Tier 2 Dependant for a Child born in USA

Hello all,

I am hoping I will get some advise on how to go about this bottleneck situations.

I am on Tier 2 visa and my partner is a dependant. Last year, we had our son in the USA which makes him a USA citizen. Six months afer birth (February 2017) they both returned to the UK. On entry, my son was stamped with a 6 months visitor visa as a USA citizen.

I had thought i would be able to apply for a tier 2 dependant on arrival but the rules which i was aware off initially stated that i cannot apply for him if he is on visitor visa. Fortunately, we had a family vacation to Paris in July, which helped in renewing his visitor visa for another 6 months. I am really keen on getting his application underway.

An idea occurred to me. Can i apply for a tier 2 visa for him from Paris, France since i cannot do it within the UK? rather than spending a lot of money going to the USA to apply ?

What other options can i pursue? You advise will be very much appreciated.

No. He needs to apply outside the UK in a country where he has permission to live on a basis other than as a temporary visitor. From what you describe, that could only be the USA. The only exceptions are if he is applying for a visitor visa, short-term study visa or EEA family permit.
