Hi everyone!

I am about to apply for an EEA Permit. I have read a lot of forums about this. And it scares a bit :oops:

But I really want to know some opinions/experiences on this.

Basically, I overstayed my visa while I was in UK, but unintentionally. I left the country and no one knows when. Cuz when I was at the airport, no one checked my passport. Now, I am married to the wonderful girl of my life. Due to this fact (history) we were afraid to apply for an EEA Permit. But time is passing and for GOSH sake I haven't seen my girl for ages now.

So we decided to apply. What do you guys think of our situation? What do we need to provide (I mean an extra) to make sure to get an EEA permit?

I know what docs are required.

Also, do i need to mention about my history on the application form?

We were married in Spain where my wife is from and we played a small wedding too based on our budget

Hi,

I am a little confused... where is your wife from ? and where are you from ? I would assume the wife is from Spain ?

what type of Visa did you have ?

Yes, my wife is from Spain and I am from Azerbaijan. But, my wife doesnt have the Spanish nationality as she is Azeri as well but she was born in Spain, if that make sense. TO be more clear, her parents moved to Spain 30 years ago and she was born in Spain. Her parents are Azeri passport holders but do have a residence already in Spain. I dont know why I am giving this info.

Currently I do not have a visa and I am going to apply for EEA Permit to join my wife!

I think you may be using the word 'nationality' in a manner that causes confusion.

The question you have answered should be understood as, 'Is your wife a citizen of Spain'.

If your wife is not a Spanish citizen, what relevant nationality does you wife hold? If she is not a national or citizen of some European state, you will have no entitlement under the EEA regulations to come to the UK. If she is nevertheless 'settled' in the UK, you may be able to join her, but you will need a settlement visa, not a family permit.

I dont know why I am feeling like I am taking an exam at the University.

Sorry again.

All i was trying to explain was, my wife is Spanish citizen. Her parents are from Azerbaijan, if this makes any sense.

I would say evidence of continuing contact, and evidence that the relationship has existed for some time. Evidence that you are both ethnically Azerbaijani might help reduce the suspicion that your marriage is a contrivance to allow you to return to the UK. ECOs seem to be applying the same test to relationships for family permits that they do for settlement visas, though they shouldn't.

The UKBA has access to the airline records, so this may or may not have been detected at the time.

That being said, under the EEA rules it should not be an insurmountable obstacle. However, your case will certainly be checked more carefully, and I would expect that the application takes a bit longer. The key is to demonstrate an ongoing and lasting relationship, so questions like where you met, how much time you have spent together etc will be relevant. And of course you should tick the other requirements: joining your wife, your wife needs to be exercising treat rights etc.

EEA processing time

Hey everyone!

I know, you might be thinking what on earth this guy is asking when you can find it all online.

I checked and it says 10 working days.

Now, I have applied on 1st of August and as per the procedure, it will be sent to dmc (decision making centre) to review and make a decision. Moreover, you can track your application online and it has not yet reached the dmc.

How long would it take? Did anyone experience this before?
