ILR application

Post by Rayyyyy » Mon Aug 07, 2017 5:48 pm

MY Tier2 Visa started from 05Sep12 which completes my 5year residence on Tier2 Visa on 05Sep2017.

However, before starting my job from 05Sep12 I went on to holiday outside UK. Now while making the ILR application I need to submit the letter from employer regarding my absence in UK however as I took this holiday before joining work so I don't have a letter from the employer confirming this 35 days long holiday.

Q1) Wondering if it is alright to write a letter by myself along with the travel stamps from passport?

My contract end date with the current employer is 31October2017 and my plan to apply in 17-18 August before 21 days from 5Sep2017

Q2) What should be the end date of my contract as it's ending just within 1-2 moths period after the end of 5years limit for the successful ILR application? Should I extended the end date or it is all-right to go with this end date?

Considering the fact that we can apply before 21 days of end of 5years period of continuous residence on tier2 visa, having the fact that I had the tier 2 visa from 5Sep2012 although I started my job in Nov 2012 not from 5Sep 2012 and I went away from UK from mid of Sep-Oct and started the job after coming back.

Q3) Am I qualified to apply in 16Aug2017?

I have a similar case, I have traveled out of UK after leaving previous company and before joining the new one.

Does this affect ILR application?

What can I do to avoid rejection?

Your employer should confirm the starting day of your work on the letter.
You also cannot have a contract end date, as under Tier 2 rules for ILR, your employer must confirm on their letter that they need you for the foreseeable future.
