CONFUSING LINK FOR ILR

Dear Peers,

I am a PBS Dependant and will complete my five years in the Tier 1 Entrepreneur category by October this year. I believe I can apply for ILR after completing 5 years in this category.

However, I am perplexed between the Rules and the Application form.

Rule 319E(d)(ii) of the rules state about residing for a continuous period of 5 years, whereas, Section 9 of the Set O form only requires declaration of CONTINUOUS RESIDENCE from the Main Applicant. Interestingly, the PBS Dependant is specifically excluded from filling in section 9.

So, if the 180 days absence rule is applicable on PBS Dependant or not is my question.
