Reject Child Passport due to WRS

I have rejected passport for my UK born daughter. Was explained that workers registration scheme didn't met requirements because I was registered excactly for 11 months instead of 12. My questions as follows - as I'm understand there is 30 days allowance dont need to be registered in any of 12months period so I should qualify for application?

As I understand it, there was an obligation to register within 30 days of starting employment. After 12 months uninterrupted employment, there was no longer a registration requirement.

A lot depends on when your child was born and your dates of employment, etc. in the U.K.- these are not shared so it is unclear if the Passport Office are right or not.

Provided you apply within a month of being employed, the whole period is counted in the 12 months requirement.

Hi . Have a question. I started my current employment on 03.12.2007 . Applied for wrs. Received it in february 2008. So does it count from february or when my employment started?

Hi gravesender, it will start from Feb 2008. They don't care when you started at the job, just the date of issue. Wife had similar, but didn't register for a couple of years. It is only relevant up to March/May/Dec 2011 (Depending on source)

If the court case finds it was illegal to extend the WRS past 2009 then it will back date the start date to 2009.

Qman- this is not correct. A person who applied for registration within 30 days of starting employment was considered in compliance with the WRS requirements.

Who's "they"?

IF it's the Passport Office (and if you still have the documents) then the appropriate remedy is the HMPO complaints procedure and/or apply to the Home Office on form NS for a Nationality Status Certificate to prove the child's British citizenship.

My apologies, in my situation, partner didn't register within the 30 days so that discretion wasn't able to be used. Still wondering if courts will genuinely uphold the backdating of qualifying periods in line with that ruling. As it stands, baby was born 2014 but mum's WRS only from 2011. If backdated to 09, then wife would have attained permanent residence around time of birth.
