EEA PR application - 5 year periods not matching up?

Post by marroncream » Wed Aug 09, 2017 8:59 pm

Hello,

I am a non-EU citizen, my husband is an Irish national. We married in July 2012 and I have an EEA residence card valid for 5 years until March 2018.

I have a few questions about applying for PR as the spouse of an EEA national, it would be great if anyone can help:

1. We have been married for over 5 years now. I read somewhere that I can apply for EEA PR as soon as I've been married for 5 years (instead of waiting for my EEA residence card to expire in March 2018), is this correct?

2. My Irish husband has lived in the UK for over 10 years since March 2007. I have to send proof of his employment in the UK for my PR application. He has worked continuously since he arrived in the UK in 2007, except for a 3-month period between May and July 2017 when he was unemployed. He has since found a new job but doesn't have any payslips yet. He didn't register as a jobseeker for that 3-month period. Since he has been in the UK for over 10 years, does this 3-month period matter?

3.I am applying for PR based on my 5 years' marriage to my husband between July 2012 and July 2017, but can I submit my husband's payslips for 5 years before this period, so that I can skip the months that he wasn't employed? Because if I submit proof of his employment between July 2012 and July 2017, I will be missing payslips for May, June, July 2017.

Thank you for your help
