Should I apply for my four-year-old son, Born abroad (Tier one General dependent) under section 3) (1) of the nationality act.
• My son will be eligible for ILR in September 2018 with his mother, but needs another visa extension, current visa will expire in May 2018.
• Father is now British citizen and my other child is also British, born in UK.
• My Son has been diagnosed with ASD (Autism spectrum disorder) and had some genetic conditions.
• No DLA has been claimed being not eligible, however EHCP (Education, Health and Care Plan) has been requested and the council agreed to an assessment which will hopefully lead to an EHCP plan to address his learning disabilities.
I want to apply early asking the Secretary of State to exercise discretion because
Due to his immigration status and disabilities he was treated differently at two schools and has limited access to all the help and support he can possibly get.
There is always a confusion what is public fund and what is not?
Also, I would like to SAVE money in term of UKIV fee i.e. (Visa Extension +NHS) + ILR+ British Registration
I understand only few parents had been successful on this forum however would like members opinion.
Any suggestion will be highly appreciated.
