salary increases

Post by adnirb » Fri Aug 11, 2017 5:58 pm

Hi there,

I'm in the process of completing my ILR application having been on Tier 2 since 2012; my salary has been increased incrementally since the amount mentioned during my last Tier 2 renewal in 2014. These increases have been under 10% and in line with the annual increments all the employees of the company receive. Since the Tier 2 employer guidance stated that only a change of salary other than changes due to annual increments or bonuses would need to be reported to them via the Sponsorship Management System, my employers felt they didn't need to update UKVI either about these increases or my annual bonus. Would this cause an issue at the time of application? My SOC code and job description have remained the same ever since I started working with my employer.

As far as I understand employer don't have to report usual pay rise every year. So you should be fine here

These increases have been under 10% and in line with the annual increments all the employees of the company receive.

10% is okay. There has been cases where employed increased pay like 45% before ILR that triggers further checks.

This should not be any issue. Few things to make sure

Thanks makky86 - and noted on the formatting! I've been earning over the £35,000 threshold since last year and will ensure the letter covers all the relevant points.

I know my employers feel they have abided correctly by the guidance, however I'm also aware that the UKVI can be very particular on these issues. I'm somewhat concerned now having heard instances of people's applications being put on hold for several months with ensuing compliance checks; and would really like to avert any complications from the outset.

I imagine updating UKVI about all the salary increments retrospectively would do more harm than good?

It would not do any harm but since its not part of sponsor license requirement so it does not matter.

As I mentioned that cases you are talking about normally sudden increase in pay rise just before ILR. In your case this is not the issue.
Just relax and apply with the required documents.

I hope things go smooth for you.

Re: salary increases/ SET (O)

Post by adnirb » Mon Sep 04, 2017 6:06 pm

Hi again,

I'm not sure if it's inappropriate to add on more questions to my older post, in which case apologies for advance in doing so and let me know if I should be creating a new post for this.

I'm now filling out the SET (O) form and have a couple of queries related to some of the questions -

My husband and I privately rent our home, and pay our rent jointly (I pay my share into his bank account where the total amount gets debited to the landlord). As I'm applying for ILR on my own however, should I only fill in the amount I pay in rent in response to the question below? Or the entire rental amount we pay together?

5.2 Do you or your partner, or both, pay
any rent or mortgage for your home? If so, how much do you
pay each month?

The other question I'm unsure about is in Section 12A -

Knowledge of language and life in the UK
If you have to complete section 4, and you and/or a partner applying with you are aged 18-64,
you must provide one of the following for each of you:

A Life in the UK test pass notification letter; and

A relevant speaking and listening qualification, as described in the guidance on our website.
www.gov.uk/government/uploads/system/up ... 85139/KoLL_
v14.0EXT.pdf

I have a Master's degree taught in the UK and will just be submitting that as language proof. Do I just ignore/not tick the box confirming I've provided the relevant speaking and listening qualification as that seems to specifically relate to a language test like IELTS?

Sorry if I'm being obtuse about these points!

You have to state the full amount as the question asks you or your part or both

Section 4. 3 already gave the option to use your UK degree as evidence of English Language proficiency. So you are fine with your UK MSc degree .

I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.

Hi @adnirb,

Can you please update about your ILR application status.

Did you get your ILR? Did Ukvi questioned you about your annual pay rises.

As I am in the same situation as yours and I Am thinking of not updating the less than 10% pay rises each year to UKVI through SMS.

your experience would be a great great great relief for me. Looking forward for your reply.
