Delay on Newborn's visa as Tier 2 Dependent

Post by awais akhtar » Mon Aug 14, 2017 12:37 pm

Hey guys,

Just would like to know, how long can you hold newborn's visa for?

I'm on Tier 2 and my extension is due on the 14th of April 2018. My wife is my dependent and we are expecting a baby in October 2017 in UK.

As we have to apply for an extension early next year so is it fine to hold baby's visa until then? or do we have to get dependent visa organised for him as soon he's born in October this year?

Secondly, how early can we apply for the extension of Tier prior to visa expiry?

Massively appreciate your help.

Best,

Awais

There is some new guidance expected which is saying u must apply within 3 months. However, this is not out yet, and there is no definitive answer.
You can apply as early as u want. 1 months,6 months, 1 year.
In your case, if u ask your employer to issue u a cos in Jan with start date of end of march, then u can apply in Jan, which should also be within 3 months of new born.

That helps. So basically we can hold baby's visa up until January and request my employer to issue a COS letter with a start date from end of March, is that right?

Thank you iworker.

yes.
An employer can issue a cos at anytime, with a max of 3 months in future start date.
Once the cos is issued, u can apply same day or next day, provided u have all the rest docs in place.
When you have your baby, u can time it such that u ask ur employer to issue cos , say, 2 months 25 days after birth of child.
