Hi All,

I hold ILR and will be applying for my british citizenship in 4 month.

I have read the full guidence and have few questions which I appreciate your input.
I mostly know the answer but looking for confirmation.

1. I can apply as soon as 1 year anniversiry is up, I belive the answer is yes.
Mine was granted on 20 Dec so I am applying on 21Dec using special delivery service.

2. Can I retain my passport and ILR visa ?
I think yes if I give it to local council to certify and send the document. I however want to go through a lawyer, so how will this work?



3. If 2 is yes then can i travel whilst my application is under consideration .

I am not sure about the answer.

4. should I hire a lawyer?
I have done my past 11 years of visa application and renewal . I have always read the guidence fully but think if you are represented by a lawyer then your application carries more weight and you won't be rejected for no good reason.

I have few parking tickets and one ticket from police but it was fine only with no penalty points. 2.5 years has passed since then and ILR did not pick on either of them even though I declared both and send a covering letter.

If you want to retain your passport you will have to submit the application in person through the NCS. If you use the NCS JCAP service you won't have to attend an interview prior to the British passport being issued and the passport will be sent once you have attended your Citizenship ceremony.


3. If 2 is yes then can i travel whilst my application is under consideration . Yes, providing you are in the UK when you are notified to provide Biometrics.

I am not sure about the answer.

4. should I hire a lawyer?

I have always read the guidence fully but think if you are represented by a lawyer then your application carries more weight and you won't be rejected for no good reason. A legal representative has no influence over your application. Rejections aren't for 'no good reason', you either meet the requirements under the British Nationality law, or you don't. A BC application is quite straightforward

You should declare the fine issued by the police. Was this given through the Court or as a Fixed Penalty Notice?

So if I use solicitors then I can't retain my document? I have to use ncs?

Could you remind me of the maximum yearly allowance for absense from the uk? Is it 60 days ? Read the guide but can't recall.

No more than 90 days absence in the 12 month period prior to the date the application is submitted. More more than 450 days during the five year period (or 270 in the 3 year qualifying period if you are married to, or a civil partner of a British citizen)

So in your view is the only way to keep my passport and visa to use ncs ?
I can't use lawyers or get it notorised?
