Health surcharge query

I was wondering if anyone ever had this issue:

We've gone through a solicitor this time after a refusal last year. When she completed the online application, we paid the visa fee but it said we're exempt from the Health surcharge. My husband is definitely not exempt. We weren't able to pay it online so unsure if this will go against the application outcome? Or when a decision is made, will they contact him to pay it?

We're on day 49 now so hopefully hear something soon....fingers crossed!!

What category of visa application were you submitting? Why did your legal rep believe your husband was exempt from paying the IHS fee?

We went for a husband settlement visa. Our solicitor doesn't believe he's exempt. I'm not military, he's ex US military. We have checked the application for mistakes and can't see any. Last year we had a refusal but had the IHS refunded. He works with NATO but not directly for NATO. We are just unsure why it came up with he's exempt.
