Is being born in the UK an advantage for getting ILR

Post by Farzam » Wed Aug 16, 2017 6:29 pm

Hi
I've been born in the UK in 1991 and stayed there continuously for 6.5 years. Since my parents weren't UK nationals I wasn't a UK national automatically. Now after nearly 20 years I'm going back to study my masters degree.
My question is, if I want to apply for an ILR later (after some years). Does being born there and staying till I was 6.5 count?or since it was broken, the amount I was there counts nothing at all?

Many Thanks.

No, there are no special concession and you will need 10 years of unbroken legal residence in order to qualify for ILR.

Being born in the UK does give certain advantages in later acquisition of British nationality if certain conditions are met. For instance, children born in the UK are entitled to registration if either one parent gets ILR. Children born in the UK and living in the UK for the first ten years of their life are entitled for life to be registered as British citizens.

But in your case, being born in the UK does not trigger any special provisions and hence it does not impact any ILR applications either positively or negatively.
