Is that right? Under the terms of the previous arrangements I don't see how Sahand was exercising EU Treaty Rights in the UK until June 2005. So doesn't the 5th anniversary come round in June 2010?2006 regulations are all that matter at this point.
Did she arrive in the United Kingdom as a Portuguese citizen? Also, when in 2001 did she arrive?Sahand wrote:Originally from east-timor but as a holder of Portuguese citizenship she has not got any problem at all. Does she need to apply for permanent in order to apply for my permanent?
This is our history in the UK:
Arrived UK: me in 2000 (as asylum seeker), she in 2001 (as Portuguese).
Lived together: From 2003.
Marriage: April 2004.
Residency: residence permit for her & residence document for me in June 2005.
Work: me from 2003 to present, she from 2004 part-time and from 2006 full-time to present.
Study: both from 2001-2004, I am candidate for Master MA in Sep 2008.
Hope this help, thank you
John wrote:Useful information. But after she arrived in February 2001, what did she do? The technical question is, in what way did she exercise her EU Treaty Rights?
You have told us that from 2004 she has been working, but prior to that? She was a student? Or what was she going?
Trying to work out if she automatically got PR status when the new EU legislation came into force on 30.04.06?
