I have helped my friend, who is from Germany, with successfully dealing with his family visa for himself, his two sons and his Pakistani wife.
Wanted to reassure anyone who is in a similar situation or have confusion over an expired non-EEA family member's permit visa.
They had all moved from Germany approximately 6 years ago and since then, he has been working in a full time, permanent position exercising his treaty rights.
As the 5 year automatically ensures PR, a certificate to confirm PR is needed for anyone who wants to either confirm this status and lead up to the application for British Citizenship.
His wife's EEA FM permit ran out in January 2017 and family members were very worried about her legality, so to give reassurance, we went through an application using EEA PR.
The two children are German born so do not have much a problem with this.
He had kept hold of the following items for submission for EEA PR for the past 5 years (incredibly organized!)
- Council tax and benefits (joint)
- Water bill (joint)
-Electricity and gas (joint)
- Tenancy Agreement (joint)
We submitted sample set of documentation from year 1 - April 2017 to prove that they have been living in the UK since they entered the UK.
- P60s since employment (with one missing year which could not be located, the HR was able to provide a cover letter
- Employment letter.
As required, the passport photos, original passports for all members as well as the new and old passport for his wife was sent.
We were highly confused if she should apply in her name, but instead, decided to apply as the EEA member (husband) and added three dependents.
Heres' the timeline:
EEA PR for 1 main applicant (German) and x 3 dependents (x2 German, 1x Pakistani)
Application sent: 5th April 2017.
Money was taken: 7th April 2017.
Biometric letter for non EEA member: 5th June 2017.
Biometrics registered for non EEA member: 8th June 2017.
COA received: 8th June 2017
(then a long wait with no response, gave up checking online!)
BRP received: 16th August 2017. Biometrics card confirms the Pakistani wife is now a permanent resident (what a relief!) Checked online service, case was decided on 10th August 2017.
Remaining documentation and PR documents for EEA members: 18th August 2017.
The waiting is the most difficult time, but, as you can see, it can be done without the use of any solicitors and used this board as my main research point to fill out the form (aching hand and many print outs were made!)
It took just over 4 months and glad we had gone through this before it all changes with Brexit. It provides the opportunity for application for BC if they wish to do so.
