Hi,
I am applying for my child who was born in India (6 months old). I have indefinite leave to remain (ILR) in the UK and I am currently in UK. My wife has dependant of a settled person VISA already but she is currently in India with her child from last 6 months.
I have a few questions which are really confusing me:
1. Am I correct in applying for my child via Family visas-> Apply as Child -> Born outside UK by filing online application form and Appendix 1? I assume my wife doesn't need to re-apply for VISA as she already has one.
2. Is it Appendix 1 or Appendix 2 that I need to fill in with this application? The visa page clearly mentions Appendix 1 to be filled in but I remember I have filled in Appendix 2 for my wife's visa where I specified how we meet the financial requirement. Do I need to fill in this form also for my child? Though Appendix 1 does asks for sponsor details, it is not clear where I specify that the financial requirement is met and how. i.e £18,600 for myself and partner + £3800 for additional child. I think I need to fill in Appendix 2 also to clarify this in my application.
3. In Appendix 1, Part 1 it says " Do not complete this part if you are applying as the child of settled parent (s) with limited leave". I am confused with this statement. I am a settled parent with ILR but it is indefinite leave. How can a settled parent be with a limited leave? Do I need to fill in this section?
4. Question 2.16 in Appendix 1 says " If you are applying for indefinite leave to enter", has your sponsor completed and signed the sponsorship undertaken form confirming they will maintain and accommodate you without recourse to public funds for 5 years" Do this apply to my child's application as he is currently applying to join the family of a settled person but not for indefinite leave to enter at the moment.
5. Who has to sign the authorisation page of above mentioned sponsorship undertaking form? It says it is for official use and I assume I should leave it for Home office to sign it? Am I correct?
I have looked at the forum.. some of the above questions were quite similar but I haven't got clarity on the above. It will be really grateful if somebody can guide me correctly on this.
