Intention to leave- tier 4 interview

Post by nhan908 » Sun Aug 27, 2017 9:23 am

Before 2015, it is stated in the policy guidance that:
'For those considered to be genuine students, intention to leave the UK at the end of the course is not relevant as there are many basis on which an individual could lawfully remain in the UK'

However the guidance is withdrawn in April, 2015. Does anyone if the new guidance for now have anything like that or are they able to refuse a Tier 4 visa under intention to leave the UK?

Cheers in advance!

No.

Not sure how you are finding old archived 2015 guidance but not current guidance! See https://www.gov.uk/government/publicati ... sed-system

Thanks for the link! I'm trying to crawl through it for the info but by 'No', do you mean they can't refuse students under intention to leave?

You are making it complicated. The answer to both your questions is No.

Does anyone [know?] if the new guidance for now have anything like that...
No.

...or are they able to refuse a Tier 4 visa under intention to leave the UK?
No.

Thank you for clarifying! I just wanted to be sure because I didn't specifically say I'll return to my home country after studying in the interview and I was a bit nervous that they could refuse the visa because of that. It's a relief now knowing they can't :)

I was more worried about them refusing for being a 'fake' student for not wanting to return home haha it's rather nerve-wracking.

Don't worry, intention to leave has not been in the Immigration Rules or in any related guidance for a long time. It is impossible to know, and irrelevant.

I just have another little question. My course actual start date is 30th Sept but in the interview I said 1st Oct for the start date, literally 1 day after (as I remembered it from the website). Do you think that this is a big deal re the credibility test?

No! You are really over-thinking this. I advise you read about what the credibility interview is testing: see pages 136-139 of the Tier 4 modernised guidance for entry clearance officers.

Yeah I mean I shouldn't really be too worried haha what scares me is the UKCISA report on students being refused for not being able to name course modules or number of students in the class and stuff which is just insane so I sort of have this fear of them finding any possible reason to refuse a visa.

I understand, but note that those are unusual examples of bad decisions, not the norm.

Given your anxiety, I strongly advise you get advice and reassurance from your Tier 4 sponsor who is always the best source of guidance on your Tier 4 application.
