Spouse visa

Post by path » Mon Aug 28, 2017 9:31 am

I am posting this question on behalf of my friend.
My friend's boyfriend has citizen in uk. He had an asylum visa in uk before getting citizenship. Earlier he used to be gay. And that was the case he has filed to get asylum visa. But through counselling ( from doctors and priests of his religion) now he has recovered. Now His family has arranged a proposal for him ( a girl ). My friend wants to know wheather she can apply for permanent residence or any other spouse visa in uk by marring this guy who is a British citizen now?
Thank you.

I think the fact that he is a British Citizen now he would be the main sponsor for the dependent in question. How ever this entirely depends on the sponsors circumstances.

There is however one question i would like to ask as the question is contradicting itself i think. You state its for a friends boyfriend (2 people) that this question is being asked on behalf of your friend, yet their family have arranged a proposal for your FRIENDS boyfriend.

So is the question for your friend who wants to marry the their boyfriend? or for the potential families proposal for your friends boyfriend?

Thanks for your reply.
This question is made on behalf of my friend ( the girl) . The boy has told her the story that he was given asylum in uk because earlier he was gay. That's why the girl wants to know wheather she can get a permanent resident in uk or spouse visa by marrying this guy ( who used to be gay when getting his uk citizenship)

And would like to know by marrying a girl , will it make this boy's citizenship to get cancelled, because he is not gay now.

Ahh, ok clears that up.
As the person already has British Citizenship they could sponsor the girl to come over and live as a couple.
Again it depends on circumstances, such as if they are married yet or not, how old the other partner is as i believe the sponsor and dependent should both be over 21 years of age for a spouse visa.

If you are not married yet you could also apply for a fiance/fiancee visa but then i believe you must have intent to marry within 6 months.

Also, it should be noted this all depends on the sponsor as well if he meets the requirements that would apply to him at time of application.

As for him having his British Citizen revoked, that would depend on the HO if they had received/gathered compelling evidence against him, such as deceiving or any acts of terrorism committed or intend to commit.

there have been cases, although mostly related to terrorism offencess committed by British Citizen not originally born here having there nationality revoked. Again all this information isn't professional advice it has just been from experience and some from information gathered on the internet. If you feel it is something that may complicate your friends case then he/she should get in touch with a registered immigration lawyer for professional and up to date advice. hope it helps somewhat.

Thanks a lot for all the replies. Much appreciated.

So basically the girl can get dependent visa by marrying this guy.

And his British citizenship will not get revoked by marrying a girl even though earlier he filled an asylum case stating he is gay.

Thank you very much

Being gay isn't an illness, you cannot 'recover' from it.

My spidey-senses are tingling with this one.....

So basically the girl can get dependent visa by marrying this guy. It may be a tough challenge to prove the relationship is genuine, after the boyfriend previously claimed to be gay. The ECO is likely to consider that this is either a sham marriage, or that false information was given in the asylum application.

And his British citizenship will not get revoked by marrying a girl even though earlier he filled an asylum case stating he is gay. No guarantee.

Thank you very much

As far as I know, he has gone through lot of counselling sessions. And the guy with whom he had the relationship earlier has cheated . So after all the heart breaks he has been upset and has received advices from religious priests.
