Tier 2 Dependent (General Partner) documents- maintainence and others

Post by manihatn » Mon Aug 28, 2017 12:01 pm

Hello all,

I have been in Tier 2 General for more than 4 years (November 2012). I recently switched to a new Tier2 employer (August 2017).

I got maried on June 4th 2017. I am planning to apply for Tier 2 dependent visa for my wife who is currently in India. I have filled the application, but need some more details about the supporting documents. I have a question regarding maintainence.

UKVI website states that I don't need to show evidence of savings for dependent If I am with an A-Rated
sponsor and CoS states that the sponsor will take care of the maintenance.

In my case, my current employer is a A-Rated sponsor and my COS states that they will show the maintenance for both me and my dependents (if any). So I am in the above case.

My cos details has the last line indicating, so this confirms the above.
Tick to certify maintenance for migrant (and dependants, if applicable): Y

When I applied for my visa, my wife didn't have her passport. So applied for my visa alone and got in late July 2017. Now my wife got her passport. So I am planning to make an application.

My question is that

If my dependent is applying separately (not with the main applicant),
if my HR provides a dependent maintenance letter indicating that that my sponsor will
show the maintenance for my wife, can I be exempted from showing the evidence of savings?

or

Is the above (exemption from showing evidence) only applicable when both the main applicant and his depends are applying together ?

Thanks a lot for your help.

Have a look at the PBS guidance - https://www.gov.uk/government/uploads/s ... n_2017.pdf

Point 62
the Tier 2 A-rated sponsor providing a written undertaking that, should it become necessary, it will maintain and accommodate the family member for a month. The undertaking may be limited provided the limit is at least £630 per family member. A Tier 2 A-rated sponsor can do this by:
a) endorsing the certification on the Certificate of Sponsorship, or
b) providing the certification in a letter from the sponsor which includes:
i. the applicant’s name,
ii. the sponsor’s name and logo, and
iii. details of any limit

Point 65
If you apply separately from the main applicant you will need to have the necessary funds to meet the maintenance requirement or have a written undertaking from an A-rated Sponsor,

You will need a written undertaking from your tier 2 sponsor (not sure if a copy of your CoS will suffice or you will need a letter). Probably provide both to be on the safe side?

Thanks amj85. I have both the endorsement in the COS and a letter from my HR. So I hope that should be fine.

Here are the following documents I am planning to submit.
I have indicated my doubts/clarifications below, if you and/or recent applicants have experience please share your comments. Hopefully it will be useful for both me and future applicants.

Application:

1. Applicant's Form (Wife's)
2. Applicant's Passport
3. Cover letter.

4. Main Applicant's passport all pages (should it be notarized ?)
5. Main Applicant's BRP Card (should this be notarized ?)
6. Main Applicant's confirmation of employment letter.

Finance:

7. endorsed (maintenance) in Certificate of Sponsorship
8. providing the certification in a letter from the sponsor that they will manage the maintenance
9. Current Payslip (August month only, as this is the payslip with my current Tier 2 Sponsor)
10. Other payslips and P60 (is this necessary ? as they are from my previous employer)

I don't intend to show any banks statements.

Relationship:

11. Marriage certificate
12. Marriage invitation, flight booking for arrival and departure
13. 10 marriage photos
14. Whats app chat for last 3 months (Selective)
15. Phone logs for last 6 months (Applicant's and Main Applicant's)

Health:
16. Applicant's TB test report

Accommodation:
17. Tenancy agreement (wife's name as permitted occupier)
18. NOC letter from Landlord

Police clearance:

19. Police clearance certificate:
My wife is current in India and never lived anywhere before.
So I presume a police clearance from India alone is mandatory.

Language Requirement:

Could someone confirm if Tier 2 dependent needs to show language fluency ?
Some forum messages indicate that they showed IELTS or verified UG degree from NARIC.
Are these mandatory?
Is there a reference somewhere where I can see more?

Thanks for reading and your help
