6 Years Discreationary Leave Settlement

hi

my uncle was given discretionary leave in on 15th Nov 2011 for 3 years(date on home office letter) but he got his BRP card 8th December 2011 and then extension for further 3 years.He wants to apply for Settlement now
The date on approval letter from home office is 15th November 2011 but the start date on BRP card is 08/12/2011 .Current expiry is 08/12/2017

Questions:-

1- What is the earliest date he can apply for ILR ...is it the date of HO letter or date on BRP card

2- If, his partner already holds British nationality,then still he has to wait for a year after ILR or he can apply for Naturalisation once he will get ILR being a spouse of British citizen but on Discretionary leave .Will it be one year on ILR and then I will be able to apply for the Naturalisation?
