Hello,
I am new to the forum. I have some queries in regards to the curtailment letter, please could someone clarify ?
The job has come to an end with the Tier 2 sponsor couple of months back and still haven't found a new Sponsor i.e the new employer and actively looking for one. Meanwhile will it be considered as overstay and have to leave the country ? But the curtailment letter is not yet received, and looking for a new job still.
Also is this going to effect ILR through 5 years ? Or ILR through 10 years because of the gap ?

Normally it takes 4-6 months to get curtailment letter which gives you another 60 days(after the day of curtailment letter) to stay in the UK. During this time you will not be considered as an overstayer.
If you have more than 60 days break between last day at previous employment and date of application for new employer then you will not be able to apply for ILR based on T2.
Provide your immigration history so far to find out if you would be able to get ILR on 10 years residency.

Thank you so very much for the reply. Your reply give me relief in one way as it is not considered as overstay. As different people give opinion and suggestions of leaving the country.
Yes, I am 7 years now in UK initially on student and post study work visa for 4 years and 3 years on Tier 2 now, with only 4months away from this country all over. Hopefully I find a sponsor soon to meet the 10 years route or else changing to other visa category.
So it is okay if there are gap between jobs over 60days for 10 years route to be eligible right?

What is the expiry date on your current BRP?
Just remember T2 issues after April 2011 will be extended maximum 6 years. So check if you will complete 10 years by this time.

Yes, 60 days gap requirement is only T2- ILR. It will not count for 10 years route.

Yes, your right I am aware of the 6 years limitation. My current BRP dates make me fall short of 4 months for the 10 years route. May be switching to other category would be a better option I think to meet up.
Also can I ask in regards to Tier 5 voluntary temporary worker visa, it is possible to switch from Tier 2 general to Tier 5 voluntary temporary worker in UK if there is a sponsor available in that category. Or switching this visa is only done by leaving UK and should be done from the Country of origin ?
