Complex Situation - Please help

Post by richardh » Tue Aug 29, 2017 8:33 am

Hello all,

I have read a number of posts on this forum, and I could not find any similar situations - please accept my apologies if there is. I was hoping I could look you to for some advice as I am in quite a complex situation, and I am not sure of the best way forward. I have tried to summarize some information below:

I am a British citizen, currently living in Dubai. I am in a same sex relationship, and recently engaged with my partner, of Pakistani origin, also holding a Dubai residence visa. From the outset, this is our first issue, as same sex relationships are illegal in the region.

We would like to make a move to the U.K., where we can start a life together, marry, and start a family, however, I am not sure of the best option for my partners visa. Obviously, same sex relationships are illegal, in both Dubai, and Pakistan, which makes applying for a visa, rather complex.

Whilst we are in a relationship, and do live together, we cannot provide the supporting documents, if we were to go down the fiancé visa route for example, as the relationship is illegal. In addition to this, due to the social taboo surrounding this, his family in Pakistan are also unaware of the relationship, he will tell them, once we have secured our future, and faces the real possibility of being disowned.

I am confident that I can find work back in the UK quite quickly. I have already initiated positive conversations with recruiters, who are confident I can secure a role earning GBP 60,000 per annum. Additionally, we have a support network, and will initially stay with my mum.

We really are desperate to make the move, so we can live freely together, however, I really do not know the options we have.

We do plan to marry, therefore, is it an option for him to enter the UK on a tourist visa, and then make an application under exceptional circumstances?

I would love the opportunity to discuss this in greater detail, and would welcome any information or clarity you can provide

Kind Regards,
Richard

You need to show you have been living together in a relationship akin to marriage or civil partnership for a period of 2 years, or you are married, otherwise you will not qualify.

Are you working and earning in Dubai?

Thank you for your reply. Yes we are both working and earning in Dubai.

Whilst we have been living together, we cannot prove this, as it is illegal to be in a same sex relationship, hence, everything is in my name.

We are engaged, however, not yet married, and plan on marrying next summer in the UK.

I would also have concerns in applying for a fiance/spouse/marriage visa from Dubai, due to the laws surrounding our relationship. I guess the visa will show my name/our relationship status etc?

Thanks again
Rich
