Non-EU Spouse Visa Refused

Even application refused. So they simply do not collect my documents, based on airline ticket and pay stub absence. So reading this forum and found a lot people with same complaint. EU freedom of movement law seems to be a law only on paper and it is extremely hard to execute your right. What is legal procedures to sue EU member of state? Is it possible to collect damages from EU member of state? Is it possible to create class action against EU member of state? Right now I send mail to the embassy with demand to explain why they do not collect my documents.

What do you mean by 'not collect your documents' Do you mean 'accept' your documents

The title of your thread is confusing. Have you applied for an Family Permit under EEA Regulations, or a Spouse visa under the UK Immigration Rules. There is a significant difference.

I applied to simple schengen visitor visa. By not collecting my documents I mean they reject to accept it. They reject to give me any letter of rejection. I ask them to put visa denied in my passport and they reject it also. My wife is Latvian. So they literally say we will not give you anything at all - nor visa nor visa rejection stamp. It was in the embassy of latvia in Washington DC. I did try embassy of Sweden they are complety broken is well. They working hours Monday and Thursday from 11am till 1pm. So it is even impossible to reach them. They redirect to private company called VFS Global. I do not understand why should I use private company to execute my right. So overall experience EU is worst then Russia and there is no family member right at all.

So you were applying for a Schengen visa, not a spouse visa.

Which country were you intending to visit? Latvia or another Schengen state? VFS are the official handling agents.

I thought my wife have right to choose any state at any time, buy tickets and travel. She also want me to be with her. I personally do not want anything. She cannot execute her right to be with me and travel. They clearly separate families. They force her to decide her plans in advance of 1 month, but her mood change more frequently. This is my case and point. I know about VFS, but they force us to pay fees to execute our right to private company. Originally she want to travel to Latvia, right now she want to travel to Iceland. Embassy of Sweden represent Iceland in DC. So I should apply - but it is impossible to do.
