GOT ILR PEO APPOINTMENT ON 6 OCT BUT HAD OVERSTAY IN THE PAST

Post by nomansaeed89 » Thu Aug 31, 2017 10:46 pm

hello to all respected members here,

I have booked my same day appointment for my 10 years ILR route. I am currently on Tier 1 Entrepreneur extension visa. I have little concerns about my immigiration history as my student was visa was once refused in 2009 and then I got the visa after 7 months in between was appeal and appeal review period my time line as follows,

student visa applied; 26 Sep 2009, expiring 30th Sep 2009
visa refused; 5th Nov for incorrect maintenance funds
appeal refused; 21 Jan 2010
launched high court appeal within 5 days

during that time University helped me as my course was still not finished and got me visa through student batch scheme and I withdrew my appeal from the high court and got the visa . all this took 7 months.

will I have any problem with my 10 years ILR and do I need to mention all these time lines

Thank you, everybody, in advance for looking my post and replying

The time you spent during appeal was protected under section 3C and counts towards lawful 10 years of stay under long residence.
Did you win the appeal or did you apply within 28 days of being refused for a new visa ?

thank you zimba for replying no i did not win the appeal after my appeal was refused I applied for the review of that decision I was given 5 days to apply for that during that review which went to upper court during that i got a call from home office case worker to withdraw my appeal as they were issuing me the visa . My university helped me and they contacted the home office to issue me the visa through student batch scheme. as I was an ongoing and full-time student and has semester remaining it all took 7 months when I didn't have a visa but I was in appeal and review appeal all that time .. I hope I am ok as I have already booked my appointment
