Switching to TIER 4 Student visa

Post by anamamena » Fri Sep 01, 2017 1:06 am

Hi All,

I came in UK Sep 2003 and was staying on student visa till Oct 2012. After then switched to PSW for 2 years. Then applied for ILR but refused due to 5 months break in 10 years chain. I then switched to TIER 2 visa and till now remaining the same. Could anyone advise me, if I could return to TIER 4 student visa again?

Thanks

Anam

How did you manage to be on student visa for 9 years?
What courses did you study for 9 years and at what levels ?
At what point did you have 5 months break in your continuity?
Why do you want to switch back to tier 4?
What course are you planning to study and at what level?

You need to provide more information so that people can give whatever suggestions or experience they have.
I guess you will only be able to switch to tier 4 if you are planning to study at a level higher than what you have already (I need to double check this). I'm also not sure if there's a restriction on the duration a person is allowed to be on student visa given that you have already spent 9years on student visa. Are you a PhD holder?
I am not a lawyer and do not claim to be one. All my comments here are based on my opinions, experience and interpretation of the appropriate UKVI guidance documents and immigration rules.
