Inviting parent on long term basis

Post by rajanb20032003 » Sun Sep 03, 2017 7:30 pm

Hi
I am having 5 year tier 2 (ICT) visa valid till 2021.
My annual salary is more than £120,000 and would like to invite my parents 70+ of age to U.K. They are fully dependent on me.

Please suggest if it is possible to get long term dependent visa (until 2021) for them ?

Thanks

No, as you don't hold settled status in the UK and there are no long-term visitor visas.

Even disregarding that, Adult Dependent Visas have become virtually impossible to get since the Immigration Rules were tightened significantly in July 2012.

The only Tier 2 (ICT) dependants who qualify as family members are:
"A ‘dependant’ is any of the following:
your husband, wife or partner
your child under 18"

They will have to apply for the regular visitors visa. Depending on your country, the duration of the visa might be 6 months.

Thanks casa and djsuccess... I am holding Indian passport.

Can I not be considered as settled since I heard that if annual salary is more than 120,000 p.a. then I can stay up to 9 years. Also I am in the only child , no brother sister to take care of parents in India. Can these points justify the need for ,y parents to stay with me ?

Ideally there should be some provision so that I can take care of my elderly parents , kindly suggest.

Many thanks

No. Settlement means someone with ILR, PR or British Citizenship. The level of your salary and a right to stay for up to 9 years doesn't give you any special concession to sponsor your parents.

In any event even if you were settled, in order for an ADV application to succeed, you would have to prove that BOTH of your parents need daily care for simple tasks such as dressing, bathing, preparing food etc., and that care is either not available in their home country, or is unaffordable. A failed application closes the door for all future visitor visas, due to the prior intention to remain long term in the UK.

To play the Devil's advocate, the view will be taken that you could reside in your home country and care for your parents there and it was your choice to move to the UK. With £120,000 p.a salary, I'm sure you would be able to pay for excellent care in India where the costs are much lower than they are here.
