Need advise for EFM

Hello everyone needs some suggestions from you all.

I, my wife and my first son hold Stamp 4 EU FAM which will expire in 2020. This residence card was granted because my elder brother (British National) did Treaty Rights in Ireland and we all lived in Ireland for more than a year.

My wife delivered the second baby in the UK as we don't have any family supports in Ireland because she had some miscarriages several times in her previous pregnancy so my Mom & Dad decided not to go back to Ireland until the baby delivered so that she can be look after by my parents and my other family members who all lives in the UK. To stay in the UK for more than 3 months we had to apply UK Residence Card which was rejected after waiting for 6 months and we were allowed for Appeal but now my solicitor telling me Judge will not hear the Appeal since the Appeal Right should not be given to Extended Family Members. However, my solicitor advised it will be better to submit the new applications. Still not sure whether this time will we get the visa? or going to spoil another 6 months.

I really want to go back to Ireland but my new born does not have Irish visa I have so much fear from Irish Immigration they may refuse all of us as we all have resided outside the Ireland for more than a year.

Has anyone gone through with the similar situation of mine? Can someone please help me out !!
