Not genuine student (245ZV) for tier 4

Hi everyone, my boyfriend's visa has been refused on the basis that he is not a genuine student. Would an appeal work? Has this happened to anyone before?

Any advice would be really helpful.

what was the rejection email? did he have a valid cas?

Hey, thank you for your reply.

It was in form of a letter. They said he wasnt able to explain why he got a low attendance and disciplinary actions from his previous university. In the letter, it was also stated that he was unable to show english proficiency during interview. Which is ridiculous because I personally know that he speaks great english (american accent) since he went to an international school his whole life. If so why did he pass his two interviews to study high school in Uk and subsequently at his previous univeristy. He did explain that his attendance was low because of family issues. His dad was suicidal, was semi bankrupt and was hospitalised for quite a while.

I really dont understand.

this is an older case of a similar rejection. The eco should give specific reasons that you can then use to challenge and ask for an admin review. where did he apply from? and when is his course date? should get in touch with his university asap so they can sort something out quick!

I have read the case but there was not an update as to whether his visa was approved in the end. He is actually applying from Hong Kong. I met him in UK. I am not sure when his course starts. I am really worried for him.

Did he take the IELTS to show english proficiency? Also, what university is he applying for?

He needs to get advice from his university.

He did IELTS 2 years ago and got 7.5. He's applying for BPP law school.

Yes, he does. But I think he most probably would have to apply again since he did not mention many key points and to add that onto the AR list now, it would not be accepted.

I would suggest contacting the uni ASAP for asap and for more time with regards to his visa reapp. All the best!

If he already has studied in UK with IELTS 7.5 band then he needs no IELTS now to upgrade his studies (as per my understanding).
