On tier 2 visa with terminal illness

Post by annaphanthao » Wed Sep 06, 2017 3:40 pm

Hi all, it's very sad and horrible that my husband who is on tier 2 visa is diagnosed with advanced cancer. I have spoken to his employer and they said he has 28 weeks for Statutory Sick Pay, but I wonder what will happen after 28 weeks? As far as I know if he is unfit for work after 28 weeks, his visa will be terminated and he will need to leave the country? I wonder if he is well enough to leave UK at that point as for now he is really weak and has to stay in hospital, he even cannot walk...Is it okay to apply for medical visa if his tier 2

We have just bought a house 2 months ago. If thing comes to worst, I (dependent visa of tier 2) would leave the country too (I don't want to be here if I no longer has my husband), but I still have to sort out the house (unfortunately the house is only under his name) so I don't know when I am not a legal owner of the house, what will happen?

I am not sure of the answer as I am not a lawyer however your story was very moving. Hang in there and I hope everything works out.

The only thing I will say is that had I been in this situation, I would have contacted my local MP and explained the whole thing. MPs have a lot of power and can persuade Home office to make consessions on compassionate grounds.
