Tier 4 Student Looking to get Residence Card to stay with Partner

Post by kasettetape » Fri Sep 08, 2017 12:19 am

Hello! I've made this post here because I'm not sure where to turn for advice. I'm a student from the US that recently graduated after studying in the UK for 4 years. I've lived with my partner that entire time, and I just moved into a short let with them for the remainder of my time in the UK, after which I will be returning home (around december). However my problem is my Tier 4 visa expires on Oct. 30th, and I've heard there is no way of extending that without starting another course which I am not looking to do. I want to just extend my stay another two months so I have time to prepare and ship my things over.

My partner is an EU national and has been allowed to live and study here without a fuss, so after some research I saw I could apply for a residency card with them as my sponser, is this true? Should I apply for this or is there a simpler solution to my problem of only needing an extra couple months in the UK :( My partner cannot leave until December, so I would like to stay with her if possible.

Thank you in advance for any advice! :)

-edit oh and Im sorry if this is in the wrong category, as im looking to switch my status I wasnt sure where to place it!

You can apply for a residence card as an unmarried partner of EEA national (providing that the EEA national is a qualified person) but you have to prove that you livesd together during the last 2 years, providing a lot of evidences, and the process takes up to 6 months during which you should not leave the country.

As dan1988uk mentioned, you can apply as an extended family member (EFM) of an European citizen to get a residence card (RC). You need to show evidence that you and your partner are in a durable relationship akin to marriage (living together for at least 2 years). You need to provide proof of cohabitation (shared bills, bank accounts, tenancy agreements, etc) and your sponsor must be a qualified person.

This process can take up to six months and you should not leave the country during your application. If you just need to stay for a couple of months, I don't know if this is convenient for you. Are you planning to return to the UK at some point?

Ah yeah I wasn't planning on returning to the UK, merely staying until December or beginning of January to stay in my house as long as possible, is there another route I should take with this then if not the Residence Card?
