Time outside of country if on an ancestral visa

Post by SHAZZY » Sun Feb 24, 2008 1:19 pm

Hello again,

Pse can u advise what would be the amount of time that u are allowed outside of the UK if u are on an ancestral visa and how does this impact on your application for ILR (in 14 months time) ?

Thanks

You need to look on www.bia.homeoffice.gov.uk but I believe the time out of the UK allowed is the same as for work permit holders, ie mot more than 6 months total, not more than 3 months in one go.

Hiya again

And if time out of country has been exceeded - what to do ? Not up for ILR application for awhile yet.

Thanks

Shazzy,
If your AV is a four year visa, you will need to extend the visa on or around the fourth year mark.
No problems with this and the extention is for a further four years or so I think.
So in your case I would wait until you have clocked up five years living in the UK less 120 days.
Good luck!

Hiya,

Its a four year visa - which would hopefully become a ILR after 4 years and then BC after a years probation - or an extra year as the rules change - would that apply here?

Do not want to have to do another 4 years!! Would HO not just add another year to the 4 years, once completed? But if an extension of 4 years does apply, would it not make sense to get the extension now rather than waste time and risk the possibility of any more changes to the rules.

Your suggestions, thanks !

Shazzy, the rules have already changed. You need 5 years on an Ancestral visa to qualify for ILR. As you have currently been given a 4 year visa, you have to extend at the earliest a month before the expiry of your current visa.

They give you a further extension of 4 years but you can apply for ILR as soon as you have spent 5 years on ancestry and your number of absences in the last 5 years before your ILR appliction is below the maximum allowed.
